Agreeing to these terms
These terms cover your use of this website and any work you hire D&L Malden Concrete Company to do. By using the site, asking for an estimate or booking a job with us, you agree to them.
If you sign a written estimate or contract with us, that document controls wherever it differs from this page. If you don't agree with these terms, please don't use the site, and call us so we can talk it through before any work starts.
What we do
D&L Malden Concrete Company is a concrete contractor based in Malden, MA. We build driveways, patios, sidewalks, steps, garage floors, slabs, footings, foundations and retaining walls, and we do decorative and stamped concrete, foundation raising and concrete cutting for homes and businesses in Malden and the cities around it.
You can see the full list of services on our home page and learn more about our crew on our About page. What we'll do on your property is whatever your written estimate or contract describes.
Estimates and pricing
We give free on-site estimates with no obligation, because we can't price concrete work fairly without seeing the ground, the access and the drainage. An estimate is based on what we can see and measure that day, and it's good for the period written on it.
Some things only show up once the old slab is broken out or the ground is dug, such as soft or wet soil under the slab, buried debris, old footings or roots. If we find something like that, we stop, show you, and explain what it changes before doing extra work. We won't charge for added work you haven't approved in writing, and that includes a text or email.
Prices and descriptions on this website are general information. They aren't a quote or an offer for your job.
Scheduling, weather and cancellation
Start dates are our best target, not a promise, because concrete depends on the weather. We won't pour in heavy rain or in temperatures that would weaken the slab, so we'll move the date and let you know as soon as we can.
After the pour, the concrete has to cure, which is the wait while it hardens to full strength before anyone walks or drives on it. We'll tell you when it's safe to use, and damage caused by using the slab before then isn't covered.
If you need to cancel or reschedule, tell us as early as you can. If we've already ordered concrete or materials, rented equipment or done prep work, you may be charged for those costs as set out in your written agreement.
Your part of the job
You agree to give our crew safe access to the work area, to clear vehicles and belongings from it, and to tell us about anything buried that we might hit, such as sprinkler lines, private lighting or drainage pipes. You're responsible for confirming your property lines, and for any homeowners association approval your property needs.
Some concrete work needs a permit from the city. If your job needs one, we'll talk about who is getting it at the estimate, and the written agreement will say so.
Payment terms
Payment amounts, any deposit and due dates are set out in your written estimate or contract. Unless it says otherwise, the balance is due when the work is finished.
If a payment is late, we may pause any remaining work until it's paid, and you agree to cover reasonable costs of collecting an unpaid balance where Massachusetts law allows it. If you think a bill is wrong, call us before the due date so we can sort it out.
Our guarantee and what concrete does
We stand behind our work, and satisfaction is guaranteed on every job. If something we built isn't right, call us and we'll come look at it. Any specific warranty, including how long it lasts, is the one written in your contract.
Concrete is a natural material, and some things are normal. Fine hairline cracks can appear even on a well-built slab, and we cut control joints, which are planned grooves, so most of that cracking happens in lines we chose. Color and texture can vary from section to section and from any sample.
Our guarantee doesn't cover damage from loads heavier than the slab was built for, deicing salts or chemicals, ground movement or drainage changes outside our work area, changes made by others, or use before the concrete has cured.
Except for the guarantee and any written warranty we give you, and to the extent the law allows, we make no other warranties, express or implied. Massachusetts law may give you rights that can't be waived, and nothing here takes those away.
Limits on our liability
We're fully licensed and insured, and we're responsible for the work we do. To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost use of your driveway, lost income or delays caused by weather or things outside our control.
To the extent the law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. These limits don't apply to damage caused by our gross negligence or willful misconduct.
Using this website
The information on this site is general and meant to help you understand concrete work. It isn't engineering advice, and we may update it at any time. Every job is different, so the plan for yours comes from the on-site estimate.
Please don't copy the site's content for commercial use without our permission, and don't use the site in any way that breaks the law or interferes with it working.
Settling a disagreement
If you have a problem with our work or a bill, call us first at (781) 288-8155. Most issues get fixed with a site visit and a straight conversation.
If we can't agree that way, we'll both try mediation in good faith before going to court. If it still isn't settled, either side can bring the dispute to a court in Massachusetts, which you agree is the right place to hear it.
Governing law
These terms and any work we do for you are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one in effect. Changes don't affect a job already under a signed agreement unless we both agree to them in writing.
Questions about these terms
If anything here is unclear, call us at (781) 288-8155 or send a message through our Contact page. We respond within 1 business day.
